Given its unique qualities, art remains one of the most challenging asset classes to convey in a tax-efficient manner that reflects the collector's intent. This panel discussion will address both inter vivos and testamentary transfers and case law developments regarding the valuation of specific objects as well as fractional interests in an art collection. Topics will include means of generating liquidity from art, like-kind exchanges, negotiation considerations for donating art to institutions, and the application of common estate planning techniques, including GRATs, sales to defective trusts, and life insurance. The discussion will also address drafting considerations for art bequests to account for tax liabilities, family dynamics, and the preservation of the collector's intent. The panel will also address the implications of creating a private foundation as a receptacle for part or all of the collection.
