This program will focus on many of the legal and business issues that come into play when lenders, developers, equity investors and other constituencies attempt the workout of a distressed commercial real estate venture. We will begin the program with a presentation concerning market conditions and emerging trends. Next up will be a discussion of the structures used to finance the acquisition and development of real estate over the course of the past 10-20 past years, as these structures are having a major impact on how problem real estate assets are being handled today. We will conclude with a discussion of the restructuring process, including pre-workout matters, restructuring agreements, foreclosure, litigation and bankruptcy issues.
