(LIVE PROGRAM) The Impact of the Dodd-Frank Act on the SEC's Enforcement Program

September 16, 2010

Responding to the financial crisis, the new Dodd-Frank Act has seriously ramped up the SEC Enforcement Division's reach and strength. Included are powerful new whistleblower provisions, easier standards for proving secondary liability, penalty awards in administrative proceedings, more expansive foreign jurisdiction, nationwide trial subpoenas - plus authorization to double the SEC's budget over five years. Counsel need to be aware of these major statutory changes, as well as how they interact with the SEC's new cooperation policy, specialized enforcement units and other internal changes over the last year. Featured will be Joan McKown, who left the SEC in July after almost two decades as the Chief Counsel of the Enforcement Division and who will shortly join Jones Day LLP. She and the other panelists, all former SEC senior officers, will assess the changes and suggest strategies for counsel to respond to the new enforcement environment at the SEC. The program will be video-linked with the DC Bar and offer presenters live in both New York and Washington, D.C.
