Intellectual property portfolios are comprising an increasingly large component of collateral offered by borrowers to support financing arrangements. A panel of intellectual property and finance attorneys will explore the many forms of IP collateral that they have seen offered as security in commercial transactions and the interplay between the UCC and federal intellectual property law. The presentation will examine concerns during the due diligence process, how security interests are granted and perfected under the various statutory schemes applicable to particular kinds of IP, enforcement of IP security interests and other practical considerations. The panel will also discuss trends and developments in the law affecting IP financing.
