The relationship between a policyholder and an insurer can become complicated in the event of a claim. A policyholder must satisfy certain conditions before coverage is considered under a policy and certain duties on the part of an insurer are triggered. Policyholders and insurers don't always agree when questions, and the extent, of coverage are presented. Bearing in mind the implied covenants to act in good faith may be mutual, differences of opinion on coverage can sometimes lead to coverage litigation including claims for extra-contractual damages. This program will present a fair and balanced view of the policyholder's and insurer's respective views on these issues, as well as a discussion of the pertinent laws in New York and New Jersey.
