When a physician testifies as a party, an expert or a treating doctor, attorneys confront a range of practical and ethical issues, including the scope and timing of CPLR 3101(d) exchanges, the preparation and exchange of reports of examining doctors, the circumstances under which a treating physician can give opinion testimony, the possibility of a pretrial hearing on whether the subject of expert testimony is accepted in the medical community and the circumstances under which an examining physician creates a physician/patient relationship with the plaintiff. Our panel of Supreme Court justices and experienced litigation attorneys will examine these and other issues in a lively and informative program with ongoing audience participation. You will learn practical approaches to the representation of physicians and their use as expert witnesses in personal injury litigation.
