(LIVE PROGRAM) Privileges in Regulatory and Criminal Investigations - Legal and Ethical Issues

The faculty will discuss the legal, strategic and ethical issues involved in the use of privileges in regulatory and criminal investigations, including independent investigations conducted by committees of corporate boards and other collective entities. Through a discussion of practical situations regularly confronted by investigators, corporate counsel and defense counsel, the faculty will analyze common practices and potential pitfalls in asserting or waiving privileges. Although the program will concentrate primarily on the attorney-client privilege, Fifth Amendment privilege and the work-product doctrine, it will also touch on less well-established information protection doctrines. The program will also include an examination and analysis of current privilege practices, policies and guidelines of the Securities and Exchange Commission, the Department of Justice and other governmental agencies, as well as possible responsive strategies.
