With the passage of the Leahy-Smith America Invents Act, which President Obama signed into law on September 16, 2011, broad revisions have been made to patent law. Issues such as first to file, prior art, subject matter of patents, prior commercial use and lawsuits by Non-Practicing Entities have all been affected. This program will address the major changes in statutory patent law as well as discussing other influential Federal Circuit decisions of the past year, including the rejection of the "25 % Rule of Thumb" for calculating damages; claims directed to Internet advertising; which abstract ideas are eligible to be patented; and streamlining the ability to get sanctions after a permanent injunction.
