The program will explore central aspects of the Padilla v. Kentucky decision, including the scope of the duty to advise the defendant concerning the immigration consequences of taking a plea. The panel will offer practical guidance to criminal defense counsel concerned with providing a proper advisal. The immigration consequences of certain criminal convictions will also be analyzed, and the impact of Nijhawan v. Holder on the categorical analysis will be discussed.
