The past several years have witnessed an explosion in white collar criminal prosecutions. Evidence of this heightened level of enforcement is not hard to find: massively larger fines and monetary penalties, dramatically longer prison sentences for individuals, substantial increases in government staffing and enforcement budgets, and the unprecedented use of aggressive investigative techniques previously reserved for organized crime investigations. The breadth of recent enforcement cases is also remarkable: financial fraud and misconduct related to the financial crisis and mortgage meltdown, violations of the Foreign Corrupt Practices Act, Ponzi schemes, and insider trading, to name a few. And investigations that were once limited to the United States now frequently involve regulators and prosecutors across the globe. The White Collar Crime Committee of the New York City Bar has assembled a comprehensive full-day program that will explore the critical developments that have characterized this new era of white collar enforcement and features keynote speeches by New York State Attorney General Eric Schneiderman and the United States Attorney for the Southern District of New York Preet Bharara. Our panels included senior government enforcement officials, judges, academics, general counsel of leading New York-based corporations and financial institutions, and top practitioners in the field. Plenary sessions focused on providing perspectives of top general counsel concerning the challenges they confront in this new era of expanded corporate prosecutions, as well as discussions of the increasing importance of media coverage in these cases and its impact on prosecutorial decision-making. We also plan break out sessions focusing on techniques for winning trials, ethical issues presented by white-collar corporate investigations, trends in white-collar sentencing, and the special challenges of handling cross-border investigations.
