Recently enacted laws like Dodd-Frank, as well as a number of regulations, precedent-setting court cases and administrative rulings, have dramatically expanded the number of whistleblowers, as well as their rights and protections. This area of the law never has been as important or as confusing. When Congress has legislated, it has done so in a piecemeal fashion, adding differing whistleblower protections with each new regulatory scheme. Against this backdrop, a panel of distinguished practitioners reviews the most important of the federal statutes and the latest rulings from our courts and administrative tribunals. Particular attentions will be paid to the False Claims Act, Foreign Corrupt Practices Act, Sarbanes-Oxley, and Dodd-Frank. What do those statues separately provide in terms of incentives and protections? What are the issues most frequently in dispute and how have the Courts resolved them? How do individuals prosecute, and employers defend, whistleblower claims? What are the best practices for proactively avoiding whistleblower claims under the various statutes?
